San Jose: Man arrested in fatal Berryessa shooting

SAN JOSE — A man has been arrested in a fatal shooting reported at a parking lot on Berryessa Road last week, authorities said.

Police officers were called around 10:25 p.m. on April 3 to a retail parking lot in the 1700 block of Berryessa Road for a report of a person on the ground, according to a San Jose Police Department news release. They arrived to find a man suffering from gunshot injuries.

The victim was taken to a hospital where he was pronounced dead, police said. He has been identified by the Santa Clara County Medical Examiner-Coroner’s Office as 61-year-old Oscar Cuevas; the agency’s records show that he was shot in the head.

Homicide detectives responded to the crime scene and “immediately identified a suspect vehicle associated to the crime scene,” police said, and they obtained a search warrant for a related residence.

During a search of the residence, police said detectives located and identified Jairo Ortiz, a 39-year-old San Jose resident, as a shooting suspect.

Ortiz was arrested and booked into the Santa Clara County Main Jail on suspicion of murder, and he was held without bail. Court records show he was charged in the homicide Wednesday.

Police did not detail what led up to the fatal shooting, which marked the city’s seventh homicide of the year investigated by SJPD. At the same point in 2024, 11 homicides had been recorded, according to data compiled by this news organization.
