San Jose: Driver hits pedestrian in city’s first traffic death of the year

SAN JOSE — A motorist hit a pedestrian Monday night in North San Jose in what police are recording as the city’s first traffic death of the year.

The collision was reported at 10:33 p.m. on Berryessa Road near Sierra Road, according to the San Jose Police Department.

An initial investigation found that a man driving a silver 2001 Toyota SUV east on Berryessa was traveling through the intersection on a green light when he hit another man walking across the street, police said.

The pedestrian was rushed to a hospital with serious injuries and was later pronounced dead, police said. The driver stopped, and there is no indication from police that he was arrested or cited.

Authorities did not immediately release the name of the man who died, pending his formal identification and notification of his next of kin by the Santa Clara County Medical Examiner-Coroner’s Office.

Police noted that the victim was not in a crosswalk when he was hit, but state law allows street crossings wherever it is deemed safe, regardless of the presence of a marked or unmarked crosswalk.
