A Toronto girl believed she was chatting with another teen online, but it turned out to be an Oakland man, police say

OAKLAND — A 23-year-old man is facing three felony counts for allegedly chatting with a Toronto girl online and exchanging explicit material, according to court records.

Kevin Cueto-Rodriguez, 23, was charged last week with two counts related to exchanging explicit material with a minor, including possession of child pornography, and a third count of contact a minor with intent to commit a sex crime. Oakland police say they learned of the alleged offenses when a Toronto investigator contacted them in January with a tip that a woman there had caught her 14-year-old daughter chatting with Cueto-Rodriguez online.

The girl believed that Cueto-Rodriguez was also 14, according to police. Authorities raided his home on Edes Avenue earlier this month and arrested him. The girl told authorities she didn’t want to exchange explicit material with Cueto-Rodriguez, but that he sent naked pictures of himself and convinced her to do the same, according to court records.

Cueto-Rodriguez has been released from jail, through a court order signed by Judge Elena Condes. The order says Cueto-Rodriguez must not access the internet, possess a phone capable of texting, interact with minors who don’t have a parent present, and that he has to report to a regional center for a “treatment plan” while on pretrial release.

The next court date has been set for March 5, records show.
